Expungement Attorneys
California Penal Code section 1203.4 allows expungement of a misdemeanor or felony conviction. To be eligible, a person must have successfully completed probation without violation. In addition, they must not be facing criminal charges currently, or be on probation for another criminal charge.
If a person completed probation, but violated that probation at some point, a special hearing can be requested to show good cause to allow expungement of their record.
Certain crimes are not eligible for expungement, including conviction for sex crimes that result in registration as a sex offender.
The benefits of an expungement are wide ranging. One of the biggest benefits is for employment purposes. Most employment applications have a section that asks whether you’ve been convicted of a crime. After successfully expunging a conviction, a person can answer “no” in that section.
Another benefit in expunging your record can be for purposes of receiving a professional license, such as a real estate or insurance license. An expungement can help assure that you will not be denied these licenses.
